Eligibility
By using KALPHR, you confirm that:
- You are legally authorized to represent your organization, or
- You are at least 18 years old and capable of entering into a binding agreement
- You will use the platform only for lawful business purposes
User Accounts & Responsibilities
- Users are responsible for maintaining the confidentiality of their login credentials.
- Any activity performed through your account is your responsibility.
- You agree to provide accurate, complete, and up-to-date information.
- You must immediately notify us if you suspect unauthorized access to your account.
- KALPHR is not responsible for any loss resulting from unauthorized account use due to user negligence.
Use of the HRMS Platform
You agree to use KALPHR only for legitimate HR and organizational purposes, including but not limited to:
- Employee attendance tracking
- Leave management
- Payroll processing
- Employee record management
- HR reporting and analytics
You must not:
- Use the platform for illegal or fraudulent activities
- Attempt to reverse-engineer, copy, or resell the software
- Upload malicious code, viruses, or harmful data
- Access data that does not belong to your organization
Employee Data & Privacy
- KALPHR processes employee data only on behalf of the client organization.
- The client is solely responsible for the accuracy, legality, and consent related to employee data uploaded.
- We take reasonable security measures to protect stored data but cannot guarantee absolute security.
- Clients must comply with applicable data protection and labor laws in India or their respective jurisdictions.
Biometric Attendance Integration
- Biometric device integration is provided as a technical service.
- Accuracy of biometric data depends on third-party hardware and network conditions.
- KALPHR is not responsible for biometric device malfunction, incorrect scans, or hardware-related issues.
- Clients are responsible for ensuring legal compliance regarding biometric data usage.
Payroll & Compliance Disclaimer
- Payroll calculations are generated based on configurations provided by the client.
- KALPHR does not provide legal, tax, or statutory compliance advice.
- Clients are responsible for verifying payroll accuracy, statutory deductions, and compliance with labor laws.
Subscription, Fees & Payments
- Certain features may require a paid subscription.
- Fees, billing cycles, and payment terms will be communicated separately.
- Failure to make timely payments may result in service suspension or termination.
- All fees are non-refundable unless explicitly stated otherwise in a written agreement.
Service Availability
- We strive to provide high service availability but do not guarantee uninterrupted access.
- Temporary downtime may occur due to maintenance, updates, or technical issues.
- KALPHR is not liable for business losses due to service interruptions.
Intellectual Property
- All rights, title, and interest in the KALPHR platform, including software, logos, designs, and content, belong to KALPHR.
- Users are granted a limited, non-transferable license to use the platform during the subscription period.
- Unauthorized copying or redistribution is strictly prohibited.
Termination
KALPHR reserves the right to:
- Suspend or terminate access for violation of these Terms
- Terminate services due to non-payment or misuse
Upon termination, access to the system may be disabled, and data retention will follow agreed policies.
Limitation of Liability
To the maximum extent permitted by law:
- KALPHR shall not be liable for indirect, incidental, or consequential damages
- This includes loss of data, profits, or business opportunities
- Use of the platform is at your own risk.
Indemnification
You agree to indemnify and hold harmless KALPHR from any claims, damages, or liabilities arising from:
- Misuse of the platform
- Violation of laws or third-party rights
- Inaccurate or unauthorized employee data handling
Governing Law & Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Gujarat, India.
Changes to Terms
KALPHR reserves the right to update or modify these Terms at any time. Continued use of the platform after changes constitutes acceptance of the revised Terms.
